Can I be a cosigner on a mortgage loan if I’ve had a recent foreclosure?

My new husband and I would like to buy a condo that is for sale down the street from me for $84K. I have a recent foreclosure (less than 6 months) on my credit from a house that I owned with my ex-husband who kept the house but stopped paying for the mortgage. I retained a lawyer and brought him for contempt of court to get my name off the mortgage but nothing was resolved in time to stop the foreclosure. My husband has good credit (mid 700s) and a steady employment history for 10 years he just doesn’t make enough to qualify on his own for a mortgage. Would he be able to put me on as a co-borrower for the benefit of the extra income (I have been self-employed for 5 years) or is the foreclosure too recent? Thanks for your help.
He has qualified for an FHA with his mom as a cosigner. We have 3.5% to put down. When he tried to qualify on his own they said he didn’t make enough. We’d rather not have his mom co-sign but if she has to it is a possibility.

Your credit will become his as soon as you apply together.
I would NOT do it. You should wait at least 2 years, 6 months is too soon

are there any new laws pertaining to foreclosures?
i owe about 195 on our first mortgage and 25 on our second.
we are current with our payments.

the house is worth about 105k right now.
what are some of our options?

Correction Landlord: Florida is a recourse state. The mortgagee has the option of seeking a deficiency judgment. Florida enacted a new law last July regarding foreclosures. The mortgagee is now required to attend mediation with the defendant after the action has been filed. If your second mortgage is with a different lender, they will loose out if foreclosure is filed. Concentrate on working with your first mortgagee.

For how long should I stop doing payments on my mortgage without getting the foreclosure notice?

Also I applied for a modification two month ago, but the lender said they need 90 days for them to give me an answer. I’m afraid to loose the house, but I don’t want to loose money either, my mortgage payment is too high. I’m four month behind.
Another thing is I file bankruptcy two years ago, and I included the house, but did not discharged it, because I wanted to try the modification first.

Is your forclosure still part of your bankruptcy – I assume a Chapter 13 repayment which is why you still do not have a discharge (which the court does – not you)

When your lender will file for foreclosure depends very much upon the status of the mortgage vis a vis the bankruptcy. They may not be able to file yet. However, by not paying you are not setting a positive scene for the approval of a loan modification.

Have you been in contact with the lender to ask them directly what they expect if they are to approve the modification? That might be the wisest thing you could do right now especially since 90 days is a long time and it is quite likely that if you don’t contact them, they might not contact you about it. You need to stay in touch with your lender.

Are you prepared to face the fact that they might not approve the modification and that ultimately you would have to move out?

Questions to also consider: the market value of your house now as compared with the balance on your mortgage. Does it actually have equity value or is the house now worth less than it was when you bought it? If the house is worth as much or more than when you bought it, you’re going to want to try to save it.

It may be possible to include the arrears in the loan modification program depending upon the underwriting of the mortgage.

Please set aside as much money as you can now.

I live in texas and have a FHA loan.

READ YOUR MORTGAGE. If you live in Texas you need to know that Texas is the easiest, quickest, cheapest state by far in which to foreclose. If you fail to pay your mortgage they can file to foreclose very quickly (maybe 10 days late for the first demand letter). With the first demand letter they can (depending on the terms of the mortgage) accelerate the mortgage, which means they can ask for the ENTIRE amount due under the mortgage. That means that if you get a job in 2 weeks and can then pay the mortgage again, you can still lose your house because you can’t pay the entire amount due. They MAY agree to let you just pay the amount you owe and late fees and move on, but they don’t have to.

As a lender, I LOVE Texas. I have gotten a house back in as little as 60 days there, whereas in Ohio it can easily take 9 months. If you are the kind of person that wants to live in a house and not pay the mortgage, move to Ohio!

They probably can’t garnish your wages to pay what you owe, because with a mortgage the collateral is the house. You agree to pay them a certain amount, and if you don’t, they get the house. They don’t get the house and your car and your boat unless those were pledged under the terms of the mortgage. Again, READ YOUR MORTGAGE. This lays out your rights and responsibilities under the terms of the contract and governs what the lender can do if you fail to live up to your end of the bargain.

If you can’t pay your mortgage, try to sell the house! TODAY! Call three real estate agents and get them to come out and tell you what they can sell it for and what they recommend you do to maximize your sale price. Do all the things that you can do quickly and cheaply and try to sell it. If you get an offer for an amount that is less that what you owe, contact your lender as see if they will accept a short sale. It’s stupid to get a foreclosure on your record when you can just sell the house!!!

Will Christine O’Donnell’s Lies About Her Federal Tax Lien and Mortgage Foreclosure Be Unmasked Soon?

Christine O’Donnell had a Federal Tax Lien filed against her by the IRS (she claimed it was filed ‘in error’) and her home was in foreclosure proceedings last year before it was sold (she claimed it was bank error at one point and then changed it to a ‘flat out lie’ and finally to "I paid off all my debts".)

It also seems that she made only about $5,500 last year…was sued by her college for tuition and did not get her degree issued until 20 years later by finally paying them back and she sued a former employer for $7 million in a sex discrimination suit for ‘mental anguish’ but later dropped the suit…

Oh by the way, she was still listed as the head of the anti-masturbation organization S.A.L.T. as late as 2009….but that didn’t stop her from saying today on NBC apparently it was a ‘youthful’ thing and she changed.

But seriously, she’s not responsible with money. That is a concern when you are dealing with BILLIONS of dollars. I seriously doubt the voters of Delaware are going to let her represent them.
