is it better to answer a mortgage foreclosure summons?

My husband was laid off in January. One of the first things we did was to call our mortgage company and try to get a modification. We got behind on the payments, and the other day a summons was dropped off. It said an answer was due in writing within 20 days. I immediately called the mortgage company, and they told me not to panic, that the modification should be approved soon and it would stop the foreclosure. I told them about the summons and they said to call the lawyer listed in it. I called the lawyer and asked them about answering the summons and told them what the mortgage company had said about the modification, She told me we didn’t have to submit a written answer to the summons if we didn’t want to, and to keep calling and checking on the status of the modification, Should we answer the summons or does it not matter? She told me that answering it wouldn’t stop the foreclosure, the only way to do that is to get the modifiication worked out. P.S. my hubby is back at work now and I’m looking for work myself, so we should be able to handle payments at a reduced interest rate,

Always answer the summons, in writing.

In the courts, if it isn’t on paper, the conversation never happened.

I live in BC Canada and there is a big chance that my house might go into foreclosure very soon if some money doesnt come through quick. I was wondering if anyone knows how long a foreclosure typically takes? Also if I paid back all the arears would I be able to stop the foreclosure even if it was already in progress?

That depends on a few things. If your bank has alot of foreclosures, then they might want to unload them as soon as possible. They may hang onto it or if they are partnered with any local real estate agencies, they may sell it to them. As far as you paying it back, you would have to talk to them and see what you can work out. Understand that if they do give you a sort of second chance to pay this, and your funding doesn’t come through, they probably won’t let you pay it once the house does go into foreclosure.

Really, you should be talking to your mortgage company about all this instead of getting people’s personal opinions. Our opinion isn’t going to help save your home. As a previous banker, I can tell you that lenders don’t tend to look to favorably on people that have had a previous foreclosure for future lending, so if another house is in your future, or you would like it to be, I would do pretty much anything I could to avoid this happening!

You can either file the bankruptcy, or go to the bank today with all of the money owed in arrears, and even that may not be enough to stop the foreclosure. Best option is to do a free consult with an attorney in your local area, and see if there are any alternatives for you, but I don’t think there is any above those mentioned. Good Luck!

If I file bankrupcy will that automatically stop the foreclosure sale of my house?

foreclosure sale set for today at 2pm. heading down to court house to file for backruptcy, this morning.
I live in AZ. and my lender has been lying, cheating…. she even took out a 2nd mortgage on MY HOUSE! we just want to stop the sale so we can show the court what’s she’s been doing.
I did the credit counselling course over the phone last night, have my printed certificate in hand.

It ALWAYS someone else’s fault, isn’t it?


NO, it’s too late to get out of it now. It’s not as easy to file for bankruptcy now as it used to be – for the very reason that people used it as a loophole to deny their own financial responsibility.
