How can I stop a foreclosure on my house?

Posted on July 26th, 2009 by Fred

Is chapter 13 the only way?

No, chapter 13 bankruptcy is not the only option. Here is a pretty good website about avoiding foreclosure. It has info about foreclosure lending scams, foreclosure timeline, some step-by-step things you can do to stop foreclosure, and some advice on how to delay the eviction process after a foreclosure sale:

is it better to answer a mortgage foreclosure summons?

Posted on July 26th, 2009 by Fred

My husband was laid off in January. One of the first things we did was to call our mortgage company and try to get a modification. We got behind on the payments, and the other day a summons was dropped off. It said an answer was due in writing within 20 days. I immediately called the mortgage company, and they told me not to panic, that the modification should be approved soon and it would stop the foreclosure. I told them about the summons and they said to call the lawyer listed in it. I called the lawyer and asked them about answering the summons and told them what the mortgage company had said about the modification, She told me we didn’t have to submit a written answer to the summons if we didn’t want to, and to keep calling and checking on the status of the modification, Should we answer the summons or does it not matter? She told me that answering it wouldn’t stop the foreclosure, the only way to do that is to get the modifiication worked out. P.S. my hubby is back at work now and I’m looking for work myself, so we should be able to handle payments at a reduced interest rate,

Always answer the summons, in writing.

In the courts, if it isn’t on paper, the conversation never happened.

If my home goes into foreclosure how long appox. will it take for the bank to sell it?

Posted on July 26th, 2009 by Fred

I live in BC Canada and there is a big chance that my house might go into foreclosure very soon if some money doesnt come through quick. I was wondering if anyone knows how long a foreclosure typically takes? Also if I paid back all the arears would I be able to stop the foreclosure even if it was already in progress?

That depends on a few things. If your bank has alot of foreclosures, then they might want to unload them as soon as possible. They may hang onto it or if they are partnered with any local real estate agencies, they may sell it to them. As far as you paying it back, you would have to talk to them and see what you can work out. Understand that if they do give you a sort of second chance to pay this, and your funding doesn’t come through, they probably won’t let you pay it once the house does go into foreclosure.

Really, you should be talking to your mortgage company about all this instead of getting people’s personal opinions. Our opinion isn’t going to help save your home. As a previous banker, I can tell you that lenders don’t tend to look to favorably on people that have had a previous foreclosure for future lending, so if another house is in your future, or you would like it to be, I would do pretty much anything I could to avoid this happening!

Excluding Bankruptcy…How do I STOP FORECLOSURE SALE May1 ,Texas?

Posted on July 26th, 2009 by Fred

I want to impose a "stay"on foreclosure sale . Am running out of time I need 60 days to re finance

You can either file the bankruptcy, or go to the bank today with all of the money owed in arrears, and even that may not be enough to stop the foreclosure. Best option is to do a free consult with an attorney in your local area, and see if there are any alternatives for you, but I don’t think there is any above those mentioned. Good Luck!

Foreclosure Rescue Services: Good Or Bad?

Posted on July 19th, 2009 by Fred

You may get a solicitation for foreclosure rescue services in the mail. Many individuals who are behind in their loan payments on their home see this as an opportunity to get things back on track. The problem is, though, that it is a dangerous situation to put yourself in. Many people need options when it comes to getting caught up. Once you get one month or more behind on your mortgage payments, you are in serious trouble with getting caught up as well as getting out of foreclosure. So, what can a person in your situation do?

How Do They Work?

Many individuals do consider these foreclosure rescue services as an option. But, you’ll need to insure that you know just what they will do to you. The service works like this.

脗路 In many areas, the companies will find your name listed on public record information and will then contact you, so you usually won’t have to bother with trying to find them.

脗路 Then, they will offer help. You give them ownership of your home and they will get your mortgage payments current.

脗路 They will then pay off the mortgage all together.

脗路 They may provide you with some small amount of money, say $500 or so.

脗路 They may provide you with several months free rent. It is rent because they now own your home. After a time period, usually 18 months, you will have had to find new financing for the home or you will likely need to move out.

脗路 If you do not find the financing, the company is likely to sell the home or to rent it to someone else.

This alternative lending to stop foreclosure is essential to helping many individuals stop themselves from losing their home. But, if you do take this road, you’ll need to realize that you are actually giving up your home to them and you will possibly lose it if you can not secure credit to get a new loan in place in the given time period. Although, they will help you to deal with the late payments on your mortgage and keep the home from entering foreclosure. If the home does enter it, you will lose the home unless you find another way to pay it off. What’s worse in that situation is that you may actually find yourself without a home and with horrible credit anyway. So, in either case, you’ll need to take risks.

There are assistance loans out there that you may be able to tap into as well. For many who have decent credit, there may be a way to refinance the mortgage to lower the monthly payment or else try to get the loan caught up. If you haven’t talked to your mortgage lender about options that they may be able to provide you with, do so as your first step. Then, use the web to find alternative types of lending opportunities for you. While foreclosure rescue services are one way to get through this difficult time, weigh your decision to do so wisely.

If I file bankrupcy will that automatically stop the foreclosure sale of my house?

Posted on July 18th, 2009 by Fred

foreclosure sale set for today at 2pm. heading down to court house to file for backruptcy, this morning.
I live in AZ. and my lender has been lying, cheating…. she even took out a 2nd mortgage on MY HOUSE! we just want to stop the sale so we can show the court what’s she’s been doing.
I did the credit counselling course over the phone last night, have my printed certificate in hand.

It ALWAYS someone else’s fault, isn’t it?

SIGH!

NO, it’s too late to get out of it now. It’s not as easy to file for bankruptcy now as it used to be – for the very reason that people used it as a loophole to deny their own financial responsibility.

Sorry. You’re just going to have to face the music on this one.
